Terms of Use

NS Visuals Estate ("the Company," "we," "us") provides premium real estate media production services including professional HDR photography, cinematic drone videography, 4K video walkthroughs, Matterport 3D virtual tours, social media content packages, and AI-enhanced listing marketing materials. Each project is tailored to the property and the client's marketing objectives.

By booking our services or creating an account on our Client Portal, you ("the Client") agree to be bound by these Terms of Use.

NS Visuals Estate retains full copyright ownership of all media produced. Upon full payment, the Client is granted a limited, non-exclusive, non-transferable license to use the delivered media for the purpose of marketing the specific property photographed. This includes use on MLS listings, brokerage websites, social media, print materials, and open house presentations.

This license remains active for the duration of the listing. After the property is sold or the listing expires, the Client may continue using the media in their personal portfolio but may not sublicense or transfer usage rights to any third party.

Extended licensing for use by developers, interior designers, staging companies, or publications requires a separate written agreement. Contact us for commercial licensing rates.

Shoots are confirmed upon booking through the Client Portal or direct communication. Once confirmed:

Cancellation more than 48 hours before the shoot: Full refund or free reschedule.

Cancellation within 24-48 hours: A 25% late-cancellation fee applies.

Cancellation within 24 hours or no-show: A 50% fee of the total service value is charged.

Weather-related rescheduling is handled at the photographer's professional discretion at no charge, as we prioritize optimal lighting conditions (golden hour, clear skies) for the best results.

Payment is due upon delivery of final edited assets unless otherwise specified in a custom agreement. Invoices are issued through the Client Portal with net-15 payment terms. High-resolution files are released immediately upon receipt of full payment.

We accept all major credit cards and digital transfers through our secure payment system. Late payments beyond 30 days may incur a 1.5% monthly service charge and suspension of Client Portal access until the balance is resolved.

NS Visuals Estate is not responsible for property conditions that may affect media quality, including but not limited to cleanliness, staging, structural defects, lighting conditions beyond our control, or access restrictions imposed by property owners or HOAs.

Our total liability for any claim arising from our services shall not exceed the total amount paid by the Client for the specific project in question. We are not liable for indirect, incidental, or consequential damages including lost sales or marketing opportunities.

The NS Visuals Estate Client Portal is provided exclusively to active clients with valid accounts. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Delivered media is stored in our systems for 90 days following delivery. After this retention period, files may be archived or permanently removed. Clients are strongly encouraged to download and back up their assets within this window. Extended storage may be available upon request.

Unauthorized access, scraping, or bulk downloading of media not assigned to your account is prohibited and may result in account termination.

All brand elements, logos, website design, portal interface, and marketing materials of NS Visuals Estate are proprietary and protected by applicable intellectual property laws. Unauthorized reproduction, modification, or use of our branding, UI design, or proprietary tools without express written consent is strictly prohibited.

NS Visuals Estate reserves the right to use delivered media in our own portfolio, website, and marketing materials unless the Client specifically requests exclusion in writing prior to the shoot.

These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these terms or our services shall be resolved through binding arbitration in Los Angeles County, California.
